1. Agreement to Terms

Welcome to PokerVis. These Terms of Service ("Terms") govern your access to and use of the PokerVis platform, website, and services (collectively, the "Service"). By accessing or using PokerVis, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Service.

PokerVis is operated by an individual based in Singapore. These Terms constitute a legally binding agreement between you and PokerVis.

2. Description of Service

PokerVis is a poker analytics and technology platform that provides:

• Session tracking and bankroll management tools
• Hand history parsing and analysis
• Statistical calculations and performance metrics
• Variance analysis and Risk of Ruin calculators
• Equity calculators and ICM tools
• AI-powered insights and analysis
• Data visualization and reporting tools

3. Eligibility

You must be at least 18 years old (or the legal age of majority in your jurisdiction) to use PokerVis.

By using the Service, you represent and warrant that:

• You are of legal age to enter into a binding agreement
• You are not prohibited from using the Service under applicable laws
• All information you provide is accurate and current
• You will comply with all applicable laws regarding online services

4. Account Registration and Security

4.1 Account Creation

• You must create an account to use certain features of PokerVis
• You must provide accurate, complete, and current information
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account

4.2 Account Restrictions

• One account per person: Each user may maintain only one account
• Account sharing: You may share your account credentials with trusted individuals, but you remain fully responsible for all activities under your account
• Account security: You must notify us immediately of any unauthorized access or security breach
• Account termination: We reserve the right to suspend or terminate accounts that violate these Terms

4.3 Account Responsibility

• You are solely responsible for any content uploaded to your account
• You are responsible for maintaining backups of your data
• We are not liable for any loss of data due to account termination or technical issues

5. Subscription Plans and Pricing

5.1 Service Tiers

PokerVis offers a freemium model:

• Free Tier: Limited access to basic features
• Premium Tier: Full access to all features via paid subscription

5.2 Subscription Options

• Monthly Subscription: Billed monthly, cancel anytime
• Annual Subscription: Billed annually, typically at a discounted rate

5.3 Payment Terms

• All fees are in USD (or other specified currency)
• Payment is processed through Stripe, our third-party payment processor
• You authorize us to charge your payment method for all applicable fees
• Prices are subject to change with 30 days' notice
• Failure to pay may result in suspension or termination of your account

5.4 No Free Trial

PokerVis does not currently offer free trials for premium features. You may test the platform using the free tier before upgrading.

5.5 No Refunds

5.6 Cancellation

• You may cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of your current billing period
• You will retain access to premium features until the end of the paid period
• No partial refunds are provided for unused time

5.7 Subscription Renewals

• Subscriptions automatically renew at the end of each billing period
• You will be charged the then-current subscription rate
• You must cancel before the renewal date to avoid being charged
• We will attempt to notify you before renewal, but are not obligated to do so

6. Acceptable Use Policy

6.1 Permitted Uses

You may use PokerVis to:

• Track your personal poker sessions and performance
• Analyze hand histories and poker statistics
• Use AI-powered tools for personal poker analysis
• Generate reports and visualizations of your data
• Use calculators and analytical tools for personal poker improvement

6.2 Prohibited Uses

You may NOT:

• Use the Service for any illegal purpose or in violation of any laws
• Violate any third-party rights, including intellectual property or privacy rights
• Upload malicious code, viruses, or harmful content
• Attempt to reverse-engineer, decompile, disassemble, or hack the Service
• Use automated tools (bots, scrapers) to access the Service without permission
• Interfere with or disrupt the Service or servers
• Impersonate others or provide false information
• Share proprietary algorithms, code, or methodologies derived from the Service
• Use the Service to compete with PokerVis or create a competing product
• Resell, redistribute, or commercialize the Service without authorization
• Abuse AI features through excessive or malicious queries
• Upload content that is offensive, harmful, or violates others' rights

6.3 Enforcement

Violation of this Acceptable Use Policy may result in:

• Warning or temporary suspension
• Permanent account termination without refund
• Legal action if applicable
• Reporting to law enforcement if illegal activity is suspected

7. Intellectual Property Rights

7.1 Your Data Ownership

• You own your data: All poker session data, hand histories, notes, and personal information you upload remain your property
• Your rights: You may export, delete, or use your data however you wish
• Your responsibility: You are responsible for ensuring you have the right to upload any data to our platform

7.2 PokerVis Intellectual Property

PokerVis and its licensors own all rights to:

• The PokerVis platform, software, and codebase
• All analytics algorithms, statistical models, and calculation methodologies
• UI/UX design, branding, logos, and trademarks
• AI-generated insights and analysis frameworks
• Documentation, guides, and educational content
• All improvements, updates, and derivative works

7.3 License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• Access and use the Service for personal, non-commercial purposes
• Use features and tools within the scope of your subscription tier
• Generate and export reports for personal use

You may NOT:

• Copy, modify, or create derivative works of our software
• Reverse-engineer or extract our proprietary algorithms
• Remove or alter any copyright notices or branding
• Use our intellectual property to create competing products

7.4 License to Your Data

By using PokerVis, you grant us a limited license to:

• Store and process your data to provide the Service
• Use your data to generate analytics and insights for you
• Create aggregated, anonymized statistics for platform improvements
• Back up your data for service reliability

We will NOT:

• Sell your personal data to third parties
• Share your identifiable data publicly without your consent
• Use your data for purposes beyond providing and improving the Service

8. AI-Powered Features

8.1 AI Services

PokerVis uses third-party AI services (Anthropic Claude, OpenAI) to provide:

• Natural language analysis of your poker performance
• AI-generated insights and recommendations
• Advanced data interpretation

8.2 AI Disclaimers

• AI-generated content is provided "as is" without guarantees of accuracy
• AI insights are not professional coaching or advice
• We are not responsible for decisions you make based on AI recommendations
• AI responses may occasionally be incorrect, incomplete, or irrelevant
• You should verify AI-generated information independently

8.3 AI Usage Limits

We reserve the right to:

• Impose rate limits on AI feature usage
• Restrict excessive or abusive AI queries
• Modify or discontinue AI features at any time

9. Data Accuracy and Liability

• You must independently verify all data and calculations
• You should not rely solely on PokerVis for critical poker decisions
• You acknowledge that software bugs may exist
• You accept full responsibility for your poker-related decisions and outcomes

• Beta features may be incomplete, unstable, or change without notice
• Beta features are provided without warranties of any kind

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using PokerVis, you consent to:

• Collection and processing of your data as described in the Privacy Policy
• Use of cookies and tracking technologies
• International data transfers as necessary to provide the Service

By Us:

If informal resolution fails, parties may agree to binding arbitration under Singapore arbitration rules.

16.5 Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class actions or representative proceedings.

17. General Provisions

17.1 Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and PokerVis regarding the Service.

17.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

17.3 Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

17.4 Assignment

You may not assign or transfer these Terms without our consent. We may assign these Terms without restriction.

17.5 Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control (natural disasters, wars, pandemics, etc.).

17.6 Language

These Terms are written in English. Translated versions are for convenience only; the English version controls.
